Victoria “Tori” Whitelaw is a Senior Attorney at Kearney, McWilliams, and Davis, PLLC with a legal practice focused on eminent domain, contracts, real estate, and resource/oil and gas law. With years of experience representing utility and oil and gas clients, both big and small, Tori provides her clients with a broad variety of supportive skills, including: contract review, negotiation, strategy development, and guidance through the civil litigation process.

  • Provided legal management and guidance on multi-million and billion-dollar midstream pipeline land acquisition projects across Texas
  • Negotiated easements, obtained temporary restraining orders related to survey access, and provided eminent domain legal representation and guidance on major midstream pipeline land acquisition projects across Texas including, but not limited to:
    • Comanche Trail and Trans-Pecos Pipelines (42” lines through West Texas Big Bend area to Mexico)
    • Gray Oak Pipeline (873 mile line from Loving County in West Texas to South Texas)
    • P66’s C2G Pipeline
    • Kinder Morgan’s Gulf Coast Express (513-mile natural gas pipeline)
    • Dean Pipeline Expansion (NGL pipeline through Gulf Coastal Counties)
    • South Texas NGL Pipelines and HSC Pipeline Partnership (NGL lines through the Houston Area)
    • Energy Transfer’s Orbit Gulf Coast and Lone Star pipelines (through the East Texas/Houston area)
    • Enterprise Product’s Midland-to-Sealy II and Midland to Echo III pipelines
  • Litigated eminent domain lawsuits through the administrative hearing stage, discovery, summary judgment, mediation, and negotiated settlement stages
    • Right to exercise eminent domain in Boerschig v. Trans-Pecos Pipeline, 872 F.3d 701 (5th Cir. 2017) https://casetext.com/case/boerschig-v-pipeline-1 and in the corresponding Texas district court case
  • Successfully resolved cases involving breach of easements, including encroachments within easement boundaries and denial of access to easement interests, and obtained temporary restraining orders and injunctive relief for clients related to various land and access right issues
  • Advised clients on contractual rights related to encroachments and correlative rights disputes
  • Assisted clients in the formation of limited liability companies, drafting of corporate documents, and development of best business practices and strategies
  • Reviewed surface title documents and advised clients on various property lien issues

Tori graduated with her Juris Doctorate and Graduate Diploma in Comparative Law from the Louisiana State University (LSU), Paul M. Hebert Law Center in 2014 and received her B.A. in International studies with a focus in Environmental Studies and French from the Texas A&M in 2011. Tori also attended the L.L.M. program in European Commerce and Trade Law, at Université Jean Moulin III, Lyon, France.

Tori is licensed to practice law in Texas and Colorado. She is based in the Denver office of Kearney, McWilliams & Davis, PLLC.
